Terms and Conditions for Waste Clearance Knightsbridge

These Terms and Conditions set out the basis on which Waste Clearance Knightsbridge provides waste removal and associated services to residential, commercial and other customers. By placing a booking, confirming a quotation or allowing our team to commence work, you agree to be bound by these Terms and Conditions.

If you do not agree to these terms, you must not use our services. You should read this document carefully before making any booking or arranging any waste collection with us.

1. Definitions

In these Terms and Conditions, the following expressions shall have the following meanings:

1.1 "Company", "we", "us" and "our" mean Waste Clearance Knightsbridge, the provider of waste removal and rubbish collection services.

1.2 "Customer", "you" and "your" mean the person, business, organisation or other entity that requests or receives services from the Company.

1.3 "Services" mean waste removal, rubbish clearance, bulky waste collection, garden waste clearance, house or office clearance and any related services provided by the Company.

1.4 "Waste" means any items, materials or rubbish presented by the Customer for collection and disposal as part of the Services, excluding any prohibited or hazardous items as set out in these terms.

1.5 "Booking" means a confirmed arrangement between the Company and the Customer for the provision of Services at an agreed time, date and location.

1.6 "Contract" means the agreement between the Company and the Customer for the supply of Services, incorporating these Terms and Conditions and any written quotation or confirmation provided by the Company.

2. Scope of Services

2.1 We provide waste removal and clearance services within our operational service area, which may vary from time to time. Availability of services is subject to vehicle routes, staff availability and local regulations.

2.2 The Services generally include loading of waste onto our vehicles, transport of such waste to an authorised facility, and lawful disposal or recovery in accordance with applicable UK waste legislation.

2.3 We reserve the right to refuse to collect any waste that we reasonably believe to be hazardous, prohibited, incorrectly described, unsafe to handle, or in breach of relevant regulations or these Terms and Conditions.

2.4 Time of arrival is approximate. We will use reasonable efforts to attend within the agreed time slot, but we do not guarantee exact times and accept no liability for delay arising from traffic, weather, access restrictions, emergencies or other factors beyond our reasonable control.

3. Booking Process

3.1 Bookings may be made by telephone, email, online form or other methods we make available from time to time. You must provide accurate and complete information about the waste to be collected, including the type, approximate volume, location and any access restrictions.

3.2 Any quotation provided prior to attendance is normally based on the description and information you supply. If, upon arrival, we find that the waste volume, type or access conditions differ significantly from what was described, we may revise the quotation, apply additional charges or decline to proceed with the service.

3.3 A Booking is only confirmed when we explicitly accept it by verbal, written or electronic confirmation. We reserve the right to decline any Booking at our sole discretion.

3.4 You must ensure that a responsible adult is present at the collection address at the scheduled time to grant access, confirm the work required, agree any revised quotation if necessary, and make payment as agreed.

3.5 For commercial customers, we may require a purchase order, written acceptance or other confirmation from an authorised representative before undertaking the Services.

4. Pricing and Quotations

4.1 Our charges may be based on the volume of waste, weight, type of materials, time required, access conditions, labour needed and disposal costs, as well as any applicable surcharges such as congestion or parking charges.

4.2 Any quotation is given in good faith based on the information available at the time but does not constitute a binding offer until a Booking is confirmed. Quotations are usually valid for a limited period, which we will indicate on request.

4.3 If during the course of the work we reasonably determine that additional labour, time or disposal costs will be incurred beyond what was originally anticipated, we will notify you and agree any revised pricing before proceeding wherever practicable.

4.4 Unless expressly stated otherwise, prices are exclusive of any applicable taxes, levies, fees, charges or duties that may be imposed by law, which shall be payable by the Customer where relevant.

5. Payments

5.1 Payment terms will be communicated at the time of Booking. For most residential customers, payment is due on completion of the Service, unless otherwise agreed in advance.

5.2 We may accept payment by cash, bank transfer, card or other methods as notified to you from time to time. We reserve the right to refuse certain payment methods in particular cases.

5.3 For commercial or account customers, payment shall be made within the period specified on the invoice. If no period is specified, payment is due within 14 days of the invoice date.

5.4 If you fail to pay any amount due, we may charge interest on the overdue sum at the statutory rate, accrue from the due date until the date of actual payment, whether before or after judgment.

5.5 We reserve the right to withhold or suspend Services, or to refuse to remove waste, if payment terms have not been complied with or any outstanding balance remains unpaid.

6. Cancellations, Rescheduling and Access

6.1 You may cancel or reschedule a Booking by giving us reasonable notice. We request at least 24 hours notice prior to the scheduled collection time.

6.2 If you cancel or reschedule with less than 24 hours notice, or if we are unable to carry out the Services due to lack of access, absence of a responsible adult, or other issues arising at the site which are within your control, we may charge a cancellation fee or call-out fee to cover our costs.

6.3 We reserve the right to cancel or reschedule a Booking at any time if we are unable to attend due to events beyond our reasonable control, including but not limited to vehicle breakdown, staff illness, severe weather, accidents or compliance concerns. In such cases, we will use reasonable efforts to notify you as soon as possible and to arrange an alternative time.

6.4 It is your responsibility to ensure suitable access for our team and vehicles, including arranging any necessary keys, permits, lift access, loading bay space or parking permissions. Any charges incurred for parking, tolls or access may be added to your invoice.

7. Customer Obligations

7.1 You must ensure that all waste presented for collection is safe to handle and is not contaminated with hazardous substances, sharp objects, dangerous liquids or any items prohibited by law.

7.2 You must inform us in advance if any of the waste includes electrical equipment, refrigerators, freezers, mattresses, tyres, plasterboard, paint, chemicals or other items that may require special handling or incur additional disposal charges.

7.3 You agree to provide accurate information about the nature and quantity of the waste. If you are unsure whether any item is hazardous or restricted, you should consult us before the Booking date.

7.4 You must ensure that the collection area is reasonably clear, safe and accessible for our team to work. We may refuse to handle waste where there is a risk to the health and safety of our staff or others.

8. Waste Regulations and Duty of Care

8.1 We operate in accordance with applicable UK waste management legislation and regulations. We will transport and dispose of waste only at authorised facilities and will take reasonable steps to ensure that materials are recovered, recycled or disposed of lawfully.

8.2 Where required, we will issue appropriate documentation such as a waste transfer note or similar record, detailing the nature of the waste and the parties involved in its transfer.

8.3 You acknowledge that you have a legal duty of care with respect to the waste you produce. By using our Services, you confirm that you have chosen a responsible waste carrier and that you will cooperate with us in providing information required for lawful documentation.

8.4 We are not responsible for any penalties, claims or losses arising from false, misleading or incomplete information provided by you in relation to the nature, origin or classification of the waste.

9. Excluded and Hazardous Waste

9.1 We do not accept certain types of waste, including but not limited to asbestos, clinical or medical waste, radioactive materials, explosives, gas cylinders, ammunition, certain chemicals, solvents and other items classified as hazardous unless specifically agreed in writing in advance.

9.2 If we discover prohibited or hazardous items after collection, we reserve the right to return such items to you or to arrange for their safe disposal at additional cost to you. We may also notify the relevant authorities where appropriate.

9.3 You agree to indemnify us against any loss, damage, liability, cost, claim or expense arising from your failure to properly identify or disclose hazardous or prohibited waste.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in carrying out the Services. However, we shall not be liable for any loss or damage arising from circumstances beyond our reasonable control.

10.2 We will take reasonable steps to avoid damage to property during the collection of waste. You should notify our team of any fragile surfaces, fixtures, fittings or items of particular value before work commences.

10.3 Our liability for damage to property directly caused by our negligence shall, in any event, be limited to the reasonable cost of repair or replacement, subject to a fair assessment of wear and tear and pre-existing condition.

10.4 We shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity or loss of use, arising out of or in connection with the provision of the Services.

10.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot be limited or excluded under applicable law.

11. Insurance

11.1 We maintain public liability insurance and other cover as required by law for the provision of our Services.

11.2 Details of our insurance cover are available on request. You are responsible for arranging any additional insurance you may require in relation to your property or business.

12. Complaints and Disputes

12.1 If you are dissatisfied with any aspect of our Services, you should notify us as soon as possible, providing details of the issue and any supporting information.

12.2 We will investigate complaints in a fair and timely manner and will aim to reach a reasonable resolution with you. This may include rectifying work, offering a partial refund or other appropriate remedy, depending on the circumstances.

12.3 Raising a complaint does not remove your obligation to pay for Services properly provided. Disputed amounts should be communicated promptly so that we may review them.

13. Data Protection and Privacy

13.1 We collect and process personal information in order to manage Bookings, provide Services, issue invoices and comply with our legal obligations.

13.2 We will handle your personal data in accordance with applicable data protection laws. We will not sell your data to third parties and will only share it where necessary for the provision of Services, for legal reasons or with your consent.

13.3 You have certain rights regarding your personal data, including the right to access and correct information we hold about you. You may contact us for further details.

14. Variations to Terms

14.1 We may amend these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice or our operational needs.

14.2 The version of the Terms and Conditions in force at the time of your Booking will normally apply to that Contract. Continued use of our Services following any change to these terms will be taken as your acceptance of the updated version for future Bookings.

15. Severability

15.1 If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any Contract between you and us shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services or any Contract, including any dispute relating to their existence, validity or termination.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation, Booking confirmation and relevant documentation, constitute the entire agreement between you and us in relation to the Services and supersede any prior understandings or agreements, whether written or oral.

17.2 You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of us that is not set out in the Contract or these Terms and Conditions.

By arranging and confirming a waste collection with Waste Clearance Knightsbridge, you agree that you have read, understood and accepted these Terms and Conditions.
